An Advance Pricing Agreement determines in advance the transfer pricing method, comparable criteria, critical assumptions and arm's length outcome for covered international transactions. Instead of defending the same pricing model in repeated annual assessments, the taxpayer agrees a forward-looking framework with the Indian tax authority and, in bilateral or multilateral cases, the relevant treaty partners.
An APA can ordinarily cover up to five prospective years. Eligible rollback provisions may extend the agreed methodology to as many as four preceding years, creating potential certainty for a total period of nine years. Rollback is not automatic: the earlier transactions must satisfy prescribed conditions and remain sufficiently comparable with the covered APA transaction.
Advance Pricing Agreement services India are particularly valuable where transactions are recurring, material and likely to attract sustained scrutiny. Common candidates include captive IT or IT-enabled services, contract research, manufacturing, distribution, royalty, intercompany finance, guarantees, procurement and complex integrated supply arrangements.

Unilateral APA
A unilateral APA is agreed between the taxpayer and the Indian tax authority. It provides Indian transfer pricing certainty and is generally simpler than a bilateral process, but it does not bind the overseas jurisdiction or automatically eliminate double taxation there.
Bilateral APA
A bilateral APA is negotiated through the competent authorities of India and a treaty partner. It aligns the treatment of the covered transaction in both countries and is often preferable where the group seeks protection from corresponding double taxation.
Multilateral APA
A multilateral APA involves India and more than one treaty jurisdiction. It may be appropriate for highly integrated transactions, regional structures or arrangements where several associated enterprises contribute to the same value chain.
Rollback
APA rollback services assess whether the agreed method can be applied to eligible earlier years. We review transaction comparability, pending proceedings, prior positions and the conditions governing each rollback year.
APA application form update
The APA application was historically associated with Form 3CED. Under the Income-tax Rules, 2026, the application framework has been consolidated into Form 51. We confirm the form, fee, filing route and procedural requirements applicable on the actual submission date.
